With the second option the customer must tick the agreement checkbox before the order can be placed in the regular online cart; if they try to continue without it, the cart returns an error and stays on the page. The same rule is enforced on catering proposal checkouts. In the current version this check is disabled (commented out) on POS/admin checkouts, so staff placing an order on a customer's behalf are not blocked by this setting.
